Terms of Service

These Terms of Service ("Terms") govern your use of Smuker ("Smuker," "we," "us," or "our"), operated at www.smuker.com. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Smuker.
1. Eligibility
You must be at least 18 years old to use Smuker. By using the service, you represent that you meet this requirement and that all information you provide is accurate. We reserve the right to terminate accounts that violate this requirement.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@smuker.com if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.
3. Plans and Billing
Free plan
The Free plan is available at no charge with limited features as described on our Plans page. No credit card is required.
Subscription plans (Pro and Premium)
Paid subscription plans are billed on a monthly or annual cycle beginning on the date you subscribe. Pro plans include a 7-day free trial. A credit card is required to start the trial; you will be charged at the end of the trial period unless you cancel before it expires. Subscriptions renew automatically unless cancelled. You may cancel at any time from your account settings. Upon cancellation, you retain access to your paid plan through the end of your current billing period — through the end of the month for monthly plans, or through the end of the year for annual plans. No access is revoked early.
Interview Sprint (one-time purchase)
The Interview Sprint is a one-time payment of $29.99 that provides 30 days of Premium access. There is no trial period for this option. Access expires 30 days after purchase and does not renew automatically.
Refund policy
All sales are final once a paid plan is activated or a free trial converts to a paid subscription. We do not offer pro-rated refunds for unused time within a billing period. If you believe you were charged in error, contact us within 14 days at support@smuker.com and we will review your case.
Price changes
We reserve the right to change pricing at any time. We will give you at least 30 days' notice before any price change affects your existing subscription, and you may cancel before the change takes effect.
4. Your Content
You retain full ownership of all content you upload or create in Smuker, including your resume, job descriptions, and practice answers. By using Smuker, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the service to you. We do not claim ownership of your content and do not use it for any purpose beyond operating the service.
5. AI-Generated Output Disclaimer
Smuker uses AI to generate interview coaching, STAR analysis, resume suggestions, cover letters, and other career-related content. This output is provided for informational and practice purposes only. It does not constitute professional career advice, legal advice, or any guarantee of employment outcomes. AI-generated content may be inaccurate, incomplete, or inappropriate for your specific situation. Smuker makes no warranty that using this service will result in interviews, job offers, or any particular career outcome. You are responsible for reviewing all AI-generated content before using it.
6. Acceptable Use
You agree not to:
- Use Smuker for any unlawful purpose or in violation of these Terms
- Upload content that infringes on the intellectual property or privacy rights of others
- Attempt to reverse-engineer, scrape, or extract data from the service in an automated manner
- Share your account credentials or allow others to use your account
- Use the service to generate content intended to deceive employers or misrepresent your qualifications
- Attempt to circumvent plan limits or billing controls
- Interfere with the security or integrity of the service
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
7. Intellectual Property
The Smuker name, logo, product design, and all original content on the platform (excluding your uploaded content) are owned by Smuker and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the service without our express written permission.
8. Disclaimer of Warranties
Smuker is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, Smuker and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the service — even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Smuker and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms.
11. Termination
You may close your account at any time from your account settings. We may suspend or terminate your access at any time for violation of these Terms, with or without notice. Upon termination, your right to use the service ceases immediately, though billing terms in Section 3 govern any refund eligibility. Sections 4, 5, 8, 9, and 10 survive termination.
12. Governing Law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
14. Fair Use of AI Features
Plans described as offering "unlimited" practice questions, scoring, or AI generation are intended for normal personal job-search use. To keep the service fast and affordable for all users, AI-powered features are subject to a generous daily fair-use limit that resets each day at midnight UTC. The vast majority of users will never reach this limit — it exists solely to prevent automated abuse and protect service quality for everyone. If you do reach the limit on a given day, your access resumes automatically the following day at no cost.
